This privacy policy is addressed to you, as a user of the www.tsve.eu website (hereinafter the “SITE”), and relates only to the SITE.

The SITE is edited by TSV Europe SAS, whose registered office is at 5 Avenue Carnot – 91300 Massy – France (hereafter “TSV Europe SAS”).

TSV Europe SAS purpose is to develop, directly or indirectly, valves trade for oil and gas industries, and more generally for transportation equipment, storage and regulation of industrial fluids.

It is important to us that you can benefit from our services with confidence and freedom. And we make every effort to respect these principles, in particular concerning the protection of your personal data. Also, the purpose of this privacy policy is to explain to you, simply and in complete transparency, what personal data processing operations concerning you are carried out by TSV Europe SAS, through the SITE, in its capacity as data controller.

The regulations applicable to the protection of personal data are as follows :

• European Regulation N° 2016/679 relating to the protection of personal data (RGPD)

• The amended Data Protection Act (DPA)

• And any other related regulations.

TSV Europe SAS, in its capacity as data controller, undertakes to respect the following essential principles :

• Collect only the data that are necessary for us in connection with the use of the SITE and services it offers;

• Leave you in control of your personal data;

• Treat your personal data in a tranparent, confidential and secure manner.

ARTICLE 1 - DEFINITIONS

The terms mentioned below have the following meaning :

• Personal data / Data : Any information relating to a person concerned directly or indirectly (identifier such as name, an identification number, an identity card number, salary, bank account information, driving or consumption habits, location data, an online identifier, etc…).

• Data controller : Refers to the entity that determines the means and purposes of processing personal data.

• Service : Refers to all services offered by TSV Europe SAS and those offered on th SITE.
• Subcontractor : Refers to the person processing personal data on behalf of the Data Controller and on his instructions.

• Processing : Any operation or set of operations carried out or not using automated processes and applied to Personal Data such as collection, access, recording, copying, transfer, conservation, storage, the crossing, the modification, the structuring, the provision, the communication, the recording, the destruction, wether in an automatic, semi-automatic or other way.
• User : Designates any person who accesses and browses the SITE either as a simple Internet user or as a customer.

ARTICLE 2 : What are these data and how are they collected?

All data concerning you is collected only directly from you :

• When you browse the SITE.

• When you wish to contact TSV Europe SAS through the online contact form on the SITE.

• When you subscribe to our Newsletter
• When you want a quote or information on our commercial offers

• During our various exchanges by emails, letters or phone calls.

The data that may be collected and processed by our services for the achievement of the purposes described in Article 4 of this privacy policy concern :

• Identification Data (Last Name, First Name, phone number, email address, Company, Job Title… for the purpose of proving the exercise of a right of access, rectification or opposition or to meet a legal obligation;

• Data relating to the monitoring of the commercial relationship : request for information, history of exchanges with TSV Europe SAS services.

• Connection data and Cookies (in accordance with Article 3);

Whatever the methos of collection, TSV Europe SAS undertakes to inform you of the purposes of the processing, of the obligatory or optional nature of the answers to be provided, of the possible consequences, with regard to it, of a lack of response, of the recipients of the data, the existence and methods of exercising their rights of access, rectification and opposition to the processing of their data.

ARTICLE 4 : For what purpose do we use your data?

Your various data may be collected by TSV Europe SAS for explicit, legitimate and determined purposes in order to ensure :

• The proper functioning and continuous improvement of the SITE, its services and functionalities;

• Management of Appointment / Contact requests;

• Management of price / quote requests;

• Sending our newsletter
• Managing requests for the right of access, rectification and opposition, erasure, limitation, portability, right to digital death and the right to lodge a complaint with the CNIL;
• The development of anonymous statistics;

• Compliance with our legal obligations and the defense of our legitimate interests in the event of litigation.

ARTICLE 5 : On what legal basis do we process your data?

The processing of your data is done on the basis of your consent (manifested by your request for contact, quote…), as well as the legitimate interest of TSV Europe SAS. When necessary under the Data Protection Act (DPA), TSV Europe SAS undertakes to obtain your consent and/or to allow you to object to the use of your data for certain purposes.

ARTICLE 6 : Who are your data intended for?

Only the authorized and determined persons mentioned below may have access to your data:

• Authorized personnel from TSV Europe SAS services

• Sub-contractors of TSV Europe SAS who act in the name and on behalf of “TSV Europe SAS” and in particular the host of the SITE.

• Any courts concerned, mediators, accountants, auditors, lawyers, bailiffs, debt collection companies,
• Third parties likely to place cookies on your terminals (computers, tablets, mobile phones, etc.) when you consent (For more details, see the specific clause dealing with cookies).

• Third party networks / social media. The SITE may use social plugins provided and operated by third-party companies, such as the Facebook button, LinkedIn, Twitter. As a result, you can send to third parties the information you view in a section of our SITE. If you are not logged in to your account opened with the third party, the latter will not be able to know your identity. If you are connected to your account opened with the third party, then the latter may link the information or actions relating to your interactions with the SITE to the account you have with the third party in question. Your data is not communicated, exchanged, sold or rented to any person other than those mentioned above.

ARTICLE 7 : For how long do we keep your data?

TSV Europe SAS undertakes that the data collected will be kept in a form allowing your identification for a period that does not exceed the period necessary for the purposes for which these data are collected and processed.

However, the processing of your data is possible for proof of a right or a contract. This data may also be kept for the purpose of complying with a legal obligation or kept in files in accordance with applicable laws and regulations.

• To respond to a contact request via the SITE contact form: the information entered directly on the online form, or that communicated subsequently within the framework of our exchanges, is kept for the time necessary to answer you.

• When you request a price / quote for services offered by TSV Europe SAS, via the online form on the WEBSITE or directly by phone or by post, your information communicated in this context is kept:

• When the quote does not lead to the conclusion of a contract: 1 year after the end of your request (or last contact).

• When the estimate leads to a contract: during the term of the contractual relationship.

• When you leave a comment under one of the publications presented on the SITE: The comment and its metadata are kept indefinitely. The information collected through the dedicated form is kept for a maximum of 3 years. At the end of this period and without action on your part, your comment will be anonymized on our SITE.

Furthermore, for the purposes of meeting its legitimate interest in ensuring the protection and defense of its rights in the event of litigation, TSV Europe SAS retains certain data for five (5) years following the end of the contractual relationship.

ARTICLE 8 : How can we control your data?

In accordance with the PCA and the RGPD, you have the following rights:

• Right of access: in order to obtain the information set out in Article 15 GDPR as well as any information relating to your personal data and copies thereof;

• Right to rectification (article 16 GDPR) of your inaccurate or incomplete personal data (which you cannot update yourself);

• Right to block or erase your personal data (article 17 RGPD), when they are inaccurate, incomplete, equivocal, out of date, or whose collection, use, communication or storage is prohibited (in know more)

• Right to withdraw your consent at any time (article 13-2c RGPD);

• Right to limit the processing of your data under the conditions provided for in Article 18 GDPR;

• Right to object to the processing of your data under the conditions provided for in Article 21 GDPR;

• Right to data portability: right to ask us for copies of the personal data (concerning you) that you have provided to us, in a structured, commonly used and machine-readable format, insofar as this is technically feasible, and when these data are subject to automated processing based on your consent or on a contract (article 20 GDPR);

• Right to lodge a complaint with the CNIL (article 77 RGPD);

• Right to define the fate of your post-mortem data and to choose whether or not we communicate your data to a third party that you have previously designated. In the event of death and in the absence of instructions from you, we undertake to destroy your data, unless their retention is necessary for evidentiary purposes or to meet a legal obligation.

These rights can be exercised, by simple request by e-mail to the address: marketing@tsve.eu, or by post to TSV Europe SAS - 5 Avenue Carnot - 91300 Massy - France, indicating your contact details (surname, first name, address, accompanied by a copy of a signed identity document) as well as the presentation of a legitimate reason when this is required by law (in particular in the event of opposition to processing based on legitimate interest ).

In the event of communication of a copy of an identity document to prove your identity, we will only keep it for the time necessary for verification or for compliance with a legal obligation.

ARTICLE 9 : Security

TSV Europe SAS and its possible subcontractors undertake to implement all the technical and organizational measures to ensure the security of the processing of personal data carried out and the confidentiality of your data, in application of the PCA, RGPD and Law No. 2018-133 of February 26, 2018 “on various provisions for adaptation to European Union law in the field of security”.

As such, TSV Europe SAS takes all useful precautions, with regard to the nature of your data and the risks presented by our processing, to preserve the security of the data and, in particular, to prevent them from being distorted, damaged, or that unauthorized third parties have access to it. ARTICLE 10 : Transfers outside the EU

The SITE is hosted in France, and TSV Europe SAS undertakes not to transfer User data outside the European Union.

In the event that he should do so, he would inform Users thereof, and take all the necessary and appropriate guarantees to ensure an adequate and sufficient level of protection in terms of data security and confidentiality, in accordance with the requirements of the PCA and GDPR.
